A Public Interest Litigation was filed by Ms. Abha Singh on 4 January 2021 in Bombay High Court to protect the members of the Internal Complaints Committees (ICC) of private companies which is set up under the Sexual Harassement of Women at Workplace (Prevention, Protection and Redressal) Act, 2013. The PIL has sought a direction to set up a commission to review the inadequacies in the Act and to frame guidelines to extend protection to ICC members.
The issue being that even though PoSH Act makes it mandatory for the companies having 10 or more employees to constitute ICC to deal with complaints regarding sexual harassment at workplace but it doesn't provide for protection of the ICC members. The members can not work in a fair manner if they aren't protected from the consequences that may lead up due to their decisions. Thus, in a way this leaves a room for arbitrariness in the private sector and natural justice goes for a toss.
